wHAT DEFECTS mAY BE ACTIONABLE?

Our team of attorneys is currently investigating issues related to moisture intrusion and high humidity levels within D.R. Horton homes. If you have noticed that parts of your D.R. Horton home do not cool, or if you experience high humidity levels, you have may have claim. Other evidence of moisture intrusion and high humidity levels are sweating vents, bubbling drywall, leaking windows and/or “weeping” windows, and mold growth.

WHAT IS THE CURRENT STATUS OF THE D.R. HORTON LITIGATION?

We initially filed a potential class action in the 19th Judicial District Court in East Baton Rouge Parish. D.R. Horton attempted to have the arbitration clause enforced, which would have removed the litigation from the court system. Our firm challenged that the arbitration clause and delegation clause (which delegates the question of whether the claim is subject to arbitration to an arbitrator rather than a court). We argued that both clauses were “unconscionable”, which means: “A contract or clause is unconscionable when at the time the contract is entered into it is so onerous, oppressive or one-sided that a reasonable person would not have freely given his consent.” The district court has allowed us to engage in discovery in an attempt to obtain evidence that consent was not freely given by D.R. Horton Louisiana customers (via high pressure sales tactics, etc.) to prove that the arbitration and delegation clauses were unconscionable. We have actively engaged in moving the litigation forward in an attempt to keep the litigation in state court. Unfortunately, given the complexity of the issues, the litigation is still in the initial stages.
